Federal agencies are now required to publicly justify more sole-source contracts for small businesses before awarding them, according to a April 18 Federal Register notice.

Contracts that fall under the new regulations include 8(a) small business sole-source contracts worth more than $20 million.

Agencies must also include why it needs the goods or services in the disclosure, what the contract provides and proof that the contract is being awarded at a fair price.

The disclosure must also include reasons why the agency did not solicit competitive bids.

The new regulations correlate with the fiscal 2010 National Defense Authorization Act.

Last month, a House Armed Services Committee panel recommended the Pentagon review acquisitions by eliminating red tape and simplifying the regulation process.
